OUR MISSION

BGE (Boissons Gazeuses Environnement) is a non-profit organization created by the Québec soft drink industry to administer the deposit/return system of single-use soft drink containers and ensure compliance with deposit laws, regulations and the Deposit Agreement.

It’s role:
• Manage the deposit/refund system as efficiently and cost-effectively as possible.
• Develop programs to maximize the recovery of returnable containers.
• Ensure that members and industry stakeholders apply the Agreement properly.

THE AGREEMENT

The deposit system for soft-drinks is governed by an Agreement that details the rights and obligations of each of the parties involved. This Agreement (“The Agreement”) complements the Act respecting the sale and distribution of beer and soft-drinks in non-returnable containers as well as the Beer and soft-drinks distributors permits regulation.

The first Agreement, administered by BGE, was reached on December 1st 1999 between the “Ministère du développement durable, de l’environnement et des parcs”, the “Société Québécoise de Récupération et de recyclage” (Recyc-Québec) and the “Association des embouteilleurs de boissons gazeuses du Québec inc.”, Boissons gazeuses environnement (BGE) and its registrants. The most recent Agreement was reached with the same partners on January 1st 2021 and will be in effect until December 31, 2022.

It has for objective to further the public interest of Quebecers by protecting the environment through the consignment, recovery and recycling of non-refillable soft drink containers.

In virtue of the Act respecting the sale and distribution of beer and soft drinks in non-returnable containers, none can sell or deliver beer or soft drinks in non-refillable containers in Quebec unless holder of a permit. The permits for the sale and the distribution of soft drinks are only issued to companies that adhere to the Agreement, on recommendation of the BGE to the Ministry of Environment.

ARTISANS

Any individual or organization that performs container recovery activities parallel to the regular recovery network such as sorting centers for curbside recycling, or charitable organizations, are considered “Artisans” for the purpose of the Agreement. These authorized individuals or organizations may have their containers recycled through conditioners or recyclers certified by Recyc-Quebec and are not required to be party to the Agreement. However, they must obtain an authorization number as an Artisan from BGE before each delivery to a certified conditioner or recycler.

In order to be considered an Artisan and obtain an authorization number, a person or organization must recover a sufficient volume of containers for BGE to determine that it is in the best interest of the deposit system to have this person or organization bring their containers directly to a conditioner or recycler instead of returning them to a retail outlet.

CERTIFIED CONDITIONERS

To obtain accredited conditioner status, the applicant must show:

• The availability of a bank guaranty or security bond.
• Must show evidence of the intent of sufficient number of clients who will prevail of the services,
• Possesses adequate technology and a process that will allow satisfactory sampling and reliable counting of containers in accordance with BGE and Recyc-Quebec criteria of accuracy,

Conditioning and recycling organizations as defined in the Agreement are certified by Recyc-Quebec, with BGE’s support, in accordance with the recycler’s certification policy. Requests for certification must therefore be forwarded to Recyc-Quebec for evaluation.

Rights and Obligations
The conditioner is committed to accurately perform the counting, weighing, measuring, controlling, surveying and verifications according to the established guidelines. The conditioners must also remit to BGE all receipts issued in a given month within a reasonable delay to allow BGE to reimbourse the deposit to the recoverers and artisans in accordance with the delay stipulated in the agreement.

INSPECTIONS PERFORMED BY BGE

To ensure compliance with the law, regulations, and the Agreement on the deposit, BGE operates a program of courtesy visits to retailers as well as a program of inspections in stores, distributors, and conditioners.

These programs aim to raise awareness and inform the various stakeholders about the different aspects of the deposit system and to ensure the effectiveness of recuperation activities. Some interventions require a legal procedure that results in the imposition of the fines provided.
